The U.S. Supreme Court on Monday threw out the 9th Circuit Court decision ordering a new trial for Peter Quinn Elvik.Elvik remains in the Nevada State Prison where he has been since he was convicted of murdering William Gibson, 63, at the Carson City gun range in 1995. He was 14 at the time of the shooting, which was the basis for the 9th Circuit’s decision ordering a new trial.The panel ruled that the trial court failed to put on the record solid evidence that Elvik understood the nature of his crime.
